Data Retention Policy
1. Purpose
This Data Retention Policy ("Policy") describes how Joyner Transportation & Logistic Services LLC ("Joyner," "we," "us," or "our") retains, archives, and deletes personal information and business records collected in connection with its services. Retention periods reflect Joyner's legal and regulatory obligations, operational needs, and commitment to data minimization principles. This Policy applies to all personal data processed by Joyner and is incorporated by reference into the Joyner Privacy Policy.
2. General Retention Principles
Joyner retains personal information and business records only for as long as necessary to fulfill the purposes for which they were collected, including:
- Providing and improving Joyner's services
- Complying with legal, regulatory, and contractual obligations
- Resolving disputes and enforcing agreements
- Maintaining accurate business, financial, and safety records
- Supporting legitimate business interests, such as fraud prevention and audit readiness
When personal information is no longer needed for these purposes and no legal hold or other retention obligation applies, Joyner deletes or anonymizes it using industry-standard methods.
3. Retention Schedule by Data Category
3.1 Account & Registration Data
Personal information collected during account creation and registration — including name, contact information, login credentials, and account preferences — is retained for the duration of the active account relationship plus three (3) years following account closure, or for such longer period as required by applicable law.
3.2 Transaction & Payment Records
Records of financial transactions, invoices, payments, and billing disputes are retained for seven (7) years from the date of the transaction, consistent with standard business and tax record retention requirements under applicable federal and state law.
3.3 Freight & Logistics Records
Standard shipment records, rate confirmations, bills of lading, and proof of delivery documents are retained for three (3) years from the date of the shipment. Records required by FMCSA regulations are retained for the period specified by the applicable regulation (typically one to three years depending on record type, consistent with 49 C.F.R. Parts 370–395). Freight claim records are retained for the longer of three (3) years or the resolution of any pending claim.
3.4 Driver & Employment Records
Employment records for W-2 employee drivers and staff are retained in accordance with applicable federal and state employment law — a minimum of three (3) years from the date of record creation or one (1) year following separation from employment, whichever is later. DOT-required driver qualification files are retained for three (3) years following separation. Pre-employment drug and alcohol test results and random testing records are retained for five (5) years as required by 49 C.F.R. Part 382.
3.5 Independent Contractor Records
Engagement records, rate agreements, 1099 tax records, and compliance documentation for independent contractors (including DSP drivers, dispatch clients, and sales agents) are retained for seven (7) years following the end of the engagement, or for such longer period as required by applicable law.
3.6 Safety & Incident Records
Accident reports, incident reports, and safety investigation records are retained for a minimum of three (3) years. Records related to fatalities, serious injuries, or incidents that result or may result in litigation are retained for the duration of any related legal proceeding plus an additional period as directed by legal counsel. Records subject to an active legal hold are retained until the hold is lifted.
3.7 Passenger & Rider Records
Trip records, booking histories, and passenger communications for Airport Shuttle, Corporate Shuttle, and Mobility services are retained for three (3) years from the date of the trip, or for such longer period as required by applicable law or pending dispute.
3.8 Joyner TMS & Platform Data
Customer data — including shipment data, user activity logs, and configuration data — stored within Joyner TMS and Joyner Vu is retained for the duration of the active subscription plus one (1) year following subscription termination or expiration. After this period, customer data is deleted or anonymized unless the customer has requested data export prior to termination. Joyner strongly encourages customers to export their data prior to terminating their subscription.
3.9 Warehousing & Inventory Records
Warehouse receipts, inventory records, fulfillment records, and returns records are retained for five (5) years from the date of the relevant transaction or the end of the storage relationship, whichever is later.
3.10 Marketing & Communications Data
Email addresses and contact information used for marketing communications are retained until the individual opts out or unsubscribes, or for three (3) years from the date of the individual's last meaningful engagement with Joyner's marketing communications, whichever comes first. Opt-out and unsubscribe records are retained indefinitely to ensure compliance with applicable anti-spam and marketing regulations.
3.11 CCTV & Dashcam Footage
Video footage from facility CCTV systems and vehicle dashcam systems is retained for thirty (30) to ninety (90) days in the ordinary course of business, absent a specific retention trigger. Footage associated with a reported incident, accident, insurance claim, or legal hold is preserved and retained until the relevant matter is fully resolved.
3.12 Customer Support Records
Records of customer support interactions — including call logs, chat transcripts, emails, and case notes — are retained for three (3) years from the date of the interaction, or for the duration of any related open dispute or claim.
4. Legal Holds
When Joyner anticipates or becomes aware of litigation, regulatory investigation, government inquiry, or audit, it will implement a legal hold that suspends the routine deletion or modification of records that may be relevant to the matter, regardless of the scheduled retention period in this Policy. Legal holds are managed by Joyner's Legal department and are lifted only when the relevant matter has been fully resolved.
5. Data Deletion & Anonymization
At the end of applicable retention periods (and in the absence of any legal hold or other retention obligation), Joyner deletes or anonymizes personal information using commercially reasonable methods designed to render the data unrecoverable and non-attributable to any individual. Anonymized data — data that cannot reasonably be used to identify an individual — may be retained indefinitely and used for analytics, business intelligence, service improvement, and reporting purposes.
6. Your Data Rights
Depending on your location and applicable law, you may have rights to access, correct, delete, or restrict the processing of personal information Joyner holds about you, subject to the retention periods and legal obligations described in this Policy. 7. Changes to This Policy
Joyner may update this Policy at any time to reflect changes in applicable law, regulatory requirements, or business practices. Material changes will be communicated via the Joyner Legal Center or by direct notice. Continued use of Joyner services after changes take effect constitutes acceptance.
