Joyner DSP — Liability & Insurance Requirements
1. Purpose
This Liability & Insurance Requirements document ("Requirements") describes the minimum insurance coverage obligations, liability framework, and risk allocation applicable to Joyner Delivery Service Partners ("DSP," "you," or "your") performing last-mile delivery services through the Joyner DSP program. These Requirements supplement and are incorporated into the Joyner DSP Delivery Partner Agreement. Maintaining the required insurance coverage is a condition of active participation in the Joyner DSP program.
2. Required Insurance Coverage
DSP must maintain the following minimum insurance coverages at all times during the term of the DSP engagement. Coverage must be in force before accepting any route assignment from Joyner.

3. Business Use Auto Insurance Requirement
Standard personal auto insurance policies typically exclude coverage when the vehicle is being used for commercial or business delivery purposes. DSPs who use a personally owned vehicle for Joyner deliveries must ensure their auto insurance policy either:
- Includes a business use or delivery endorsement that covers the vehicle during commercial delivery operations; or
- Is a commercial auto liability policy that covers the vehicle for for-hire delivery use
DSPs who operate under a standard personal auto policy without a business use endorsement and who are involved in an accident while performing Joyner deliveries may find their personal auto policy denies the claim. Joyner is not responsible for coverage gaps resulting from a DSP's failure to obtain appropriate commercial or business-use auto coverage. Joyner strongly recommends consulting with a licensed insurance agent about appropriate coverage before beginning deliveries.
4. Certificate of Insurance Requirements
Prior to accepting any route assignment from Joyner, DSP must provide:
- A current certificate of insurance (ACORD 25 or equivalent) evidencing all required coverages
- The certificate must name Joyner Transportation & Logistic Services LLC as an additional insured on the commercial auto liability and general liability policies
- The certificate must provide for at least thirty (30) days' advance notice to Joyner of any cancellation or material reduction in coverage
- Updated certificates must be provided upon each policy renewal and within five (5) business days of any change in coverage
Submit certificates of insurance to dsp@myjoyner.com. Route assignments will be suspended if Joyner does not have a current, valid certificate of insurance on file for the DSP.
5. DSP Liability for Package Loss & Damage
DSP is liable to Joyner for loss of or damage to packages in DSP's custody from the time of pickup scan confirmation through delivery confirmation in the Joyner app. DSP's maximum liability per package is $100.00, unless a higher declared value is specified in the delivery manifest. This cap reflects the released value applicable to last-mile delivery under these Requirements.
5.1 How Package Loss & Damage Claims Are Handled
- DSP must report any package loss or damage to Joyner dispatch immediately upon discovery
- Joyner will investigate the claim using app data, delivery photographs, and DSP statements
- If DSP is found liable for the loss or damage, Joyner will deduct the applicable amount (up to $100 per package) from DSP's next payment cycle
- For high-value shipments where cargo insurance is required, DSP must file a claim with its cargo insurer and cooperate with the claims process
5.2 Exclusions from DSP Package Liability
DSP is not liable for package loss or damage caused by:
- Improper or inadequate packaging by the shipper
- Inherent fragility of the item not disclosed or not apparent from the package exterior
- Recipient refusal or incorrect address information provided by the shipper
- Theft from a delivery location after confirmed delivery (post-delivery porch theft)
- Force Majeure Events — severe weather, natural disaster, or other circumstances beyond DSP's reasonable control
6. DSP Liability for Third-Party Claims
DSP is solely responsible for any claim by a third party — including delivery recipients, property owners, pedestrians, or other motorists — arising from DSP's performance of delivery services, including:
- Vehicle accidents caused by DSP's negligent driving
- Property damage caused by DSP at a delivery location (e.g., damaged door, landscaping, gate)
- Personal injury to a recipient or bystander caused by DSP's conduct
- Slip-and-fall or similar incidents at a delivery location caused by DSP
DSP's commercial auto and general liability insurance is the primary coverage for such third-party claims. DSP agrees to indemnify Joyner for any amounts Joyner is required to pay to third parties arising from DSP's conduct, to the extent not covered by DSP's insurance.
7. Joyner's Contingent Coverage
Joyner maintains contingent commercial auto liability coverage that may apply in limited circumstances where DSP's own insurance is inadequate, denied, or lapsed — specifically, for bodily injury or property damage to third parties caused by DSP's negligent operation of a vehicle during an active Joyner delivery. Joyner's contingent coverage:
- Is secondary to DSP's own auto liability coverage — DSP's policy must be exhausted first
- Does not cover DSP's own injuries or vehicle damage
- Does not cover package loss or damage
- Does not apply where DSP's insurance was deliberately allowed to lapse
- Does not create any employment relationship between Joyner and DSP
The existence of Joyner's contingent coverage does not reduce or replace DSP's obligation to maintain the required insurance coverage at all times.
8. Lapsed or Inadequate Insurance
If Joyner becomes aware that DSP's insurance coverage has lapsed, been cancelled, or fallen below the required minimums, Joyner will:
- Immediately suspend DSP's route assignments until proof of reinstated or compliant coverage is provided
- Not be liable for any claims arising during the period of lapsed or inadequate coverage
- Terminate the DSP engagement if coverage is not reinstated within five (5) business days of Joyner's written notice
DSPs who perform deliveries without required insurance coverage are in material breach of the Delivery Partner Agreement and assume full personal liability for any resulting claims.
9. Accident Reporting
In the event of any vehicle accident occurring during a Joyner delivery shift, DSP must:
- Stop immediately (where safe to do so) and ensure the safety of all persons involved
- Call 911 if there are injuries, fatalities, or significant property damage
- Notify Joyner dispatch within two (2) hours of the accident
- Not admit fault, make statements to third parties about the cause, or agree to any settlement without consulting their insurance carrier
- File a claim with their auto insurance carrier promptly
- Cooperate with Joyner's accident reporting process and provide Joyner with a copy of the police report (if one was filed) within five (5) business days
10. Governing Law & Dispute Resolution
All disputes arising out of or relating to these Requirements are subject to the Joyner Arbitration & Dispute Resolution Policy. These Requirements are governed by the laws of the State of Georgia.
