Joyner Mobility — Medical Liability Disclaimer
1. Purpose
This Medical Liability Disclaimer ("Disclaimer") describes the limitations of Joyner Transportation & Logistic Services LLC's ("Joyner," "we," "us," or "our") liability in connection with medical events, health outcomes, and clinical decisions arising during or in connection with Joyner Mobility non-emergency medical transportation ("NEMT") and assisted transportation services. By booking or using Joyner Mobility services, you acknowledge and agree to the terms of this Disclaimer. This Disclaimer supplements and is incorporated into the Joyner Mobility Rider Policy and the Assisted Transportation Disclaimer.
2. Joyner Mobility Is Not a Medical Service Provider
Joyner Mobility provides non-emergency ground transportation services only. Joyner is not a healthcare provider, medical facility, home health agency, hospice provider, or emergency medical services (EMS) provider. Joyner Mobility services do not constitute medical care, clinical treatment, skilled nursing care, personal care services, or any other healthcare service regulated under applicable state or federal healthcare law.
Joyner drivers and CNAs who accompany riders during transport are providing transportation assistance — not healthcare services. CNAs employed or contracted by Joyner in connection with Mobility Services act in a transportation aide capacity only and are not providing skilled nursing or clinical care during transport.
3. No Medical Advice or Clinical Decisions
Joyner, its drivers, and its CNAs do not provide medical advice, clinical assessments, diagnoses, or treatment recommendations. Nothing communicated by a Joyner driver or CNA during the course of a Mobility Services trip — including observations about a rider's apparent condition, comfort, or demeanor — constitutes medical advice or a clinical determination and should not be relied upon as such.
All clinical decisions regarding a rider's fitness for transport, medical needs during transport, and post-transport care remain the exclusive responsibility of the rider's licensed healthcare providers, treating physicians, and authorized caregivers.
4. Pre-Existing Medical Conditions
Joyner is not liable for the exacerbation, progression, or adverse effects of any pre-existing medical condition that occurs during or following Joyner Mobility transport, where such exacerbation or adverse effect is not caused by Joyner's negligence. Riders with complex medical conditions, unstable health status, or conditions that may be affected by vehicle motion, temperature, or physical repositioning are advised to consult with their treating physician before scheduling non-emergency transportation.
By booking Joyner Mobility services, the rider (or the person booking on the rider's behalf) represents that the rider has been assessed by an appropriate healthcare provider as medically stable and suitable for non-emergency ground transportation at the time of the scheduled trip, or accepts full responsibility for any medical risk associated with transport if no such assessment has been obtained.
5. Medical Events During Transport
In the event that a rider experiences a medical event during transport — including but not limited to cardiac events, respiratory distress, seizures, loss of consciousness, diabetic emergencies, or falls — Joyner's drivers and CNAs will:
- Immediately stop the vehicle in a safe location
- Call 911 and request emergency medical services
- Remain with the rider and provide basic first aid within their training level (including CPR and AED use where the driver is trained and certified and equipment is available)
- Contact the rider's emergency contact if one has been provided at the time of booking
- Contact Joyner dispatch immediately
- Cooperate fully with responding emergency medical personnel
Joyner is not liable for medical outcomes resulting from events that occur during transport and that are not caused by Joyner's negligence, including outcomes resulting from the underlying medical condition of the rider or the inherent risks of the rider's health status at the time of transport.
6. Falls During Transport
Joyner takes reasonable precautions to minimize the risk of falls during boarding, alighting, and transit, including providing physical assistance within the scope described in the Assisted Transportation Disclaimer and using appropriate vehicle securement systems. However, Joyner is not liable for falls that result from:
- The rider's underlying mobility impairment, balance disorder, or medical condition
- The rider's refusal of offered physical assistance
- Falls that occur outside the vehicle on public or private property not under Joyner's control
- Falls during transit caused by sudden, unforeseeable road conditions or traffic events
- Falls resulting from the rider's failure to disclose mobility limitations at the time of booking
7. Medical Equipment
Riders who bring portable medical equipment — including oxygen concentrators, oxygen tanks, CPAP/BiPAP machines, IV pumps, feeding pumps, or similar devices — are responsible for:
- Ensuring the equipment is in safe operating condition prior to transport
- Operating the equipment themselves or through an accompanying caregiver during transport
- Ensuring adequate battery life, oxygen supply, or other consumables for the duration of the trip
- Disclosing all medical equipment at the time of booking so Joyner can ensure appropriate vehicle capacity
Joyner drivers and CNAs are not trained to operate, adjust, troubleshoot, or take responsibility for medical equipment. Joyner is not liable for medical outcomes resulting from equipment malfunction, depletion of supplies, or improper operation of rider-supplied medical equipment during transport.
8. Medication Management
Joyner drivers and CNAs do not administer, prepare, or assist with medications of any kind during transport. Riders who require medication administration during transport must arrange for a licensed healthcare professional or authorized caregiver to accompany them and manage their medication needs. Joyner is not liable for any medical outcome resulting from a rider's inability to receive medication during transport.
9. Managed Care & Healthcare Provider Coordination
Where Joyner Mobility services are arranged through a managed care organization (MCO), Medicaid program, or healthcare facility, Joyner's transportation obligations are defined by the applicable transportation authorization and these Terms. Joyner does not assume responsibility for the clinical appropriateness of transportation authorizations issued by MCOs or healthcare providers, and is not liable for outcomes resulting from transportation that was authorized but clinically inappropriate for the rider's condition.
10. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, JOYNER'S LIABILITY FOR ANY MEDICAL EVENT, HEALTH OUTCOME, INJURY, OR DEATH OCCURRING DURING OR IN CONNECTION WITH JOYNER MOBILITY SERVICES IS LIMITED TO DIRECT DAMAGES CAUSED BY JOYNER'S OWN NEGLIGENCE IN THE PERFORMANCE OF TRANSPORTATION SERVICES. JOYNER IS NOT LIABLE FOR: (A) MEDICAL EVENTS OR OUTCOMES RESULTING FROM THE RIDER'S PRE-EXISTING MEDICAL CONDITIONS; (B) CLINICAL DECISIONS MADE BY HEALTHCARE PROVIDERS BEFORE, DURING, OR AFTER TRANSPORT; (C) OUTCOMES RESULTING FROM THE RIDER'S REFUSAL OF OFFERED ASSISTANCE; (D) MALFUNCTION OR INADEQUACY OF RIDER-SUPPLIED MEDICAL EQUIPMENT; (E) OUTCOMES RESULTING FROM INACCURATE OR INCOMPLETE DISCLOSURE OF THE RIDER'S MEDICAL OR MOBILITY NEEDS AT BOOKING; OR (F) CONSEQUENTIAL, INDIRECT, SPECIAL, OR PUNITIVE DAMAGES OF ANY KIND.
JOYNER'S TOTAL LIABILITY FOR ANY SINGLE INCIDENT ARISING FROM JOYNER MOBILITY SERVICES SHALL NOT EXCEED THE LIMITS OF JOYNER'S APPLICABLE COMMERCIAL AUTOMOBILE LIABILITY INSURANCE POLICY.
11. Indemnification
The rider (or the person who booked services on the rider's behalf) agrees to indemnify, defend, and hold harmless Joyner and its affiliates, officers, employees, drivers, and CNAs from and against all claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising from: (a) inaccurate or incomplete disclosure of the rider's medical condition, mobility needs, or equipment requirements at the time of booking; (b) the rider's pre-existing medical conditions; (c) the rider's refusal of offered assistance; (d) the acts or omissions of personal care attendants or healthcare providers accompanying the rider; or (e) claims by third parties arising from the rider's medical condition during transport.
12. Governing Law & Dispute Resolution
This Disclaimer is governed by the laws of the State of Georgia. Disputes are subject to the Joyner Arbitration & Dispute Resolution Policy.
