Joyner Pilot / Escort — Liability Disclaimer

1. Purpose

This Liability Disclaimer ("Disclaimer") describes the scope and limitations of Joyner Transportation & Logistic Services LLC's ("Joyner," "we," "us," or "our") liability in connection with pilot car and escort vehicle services provided for oversize and overweight load movements. Pilot car operations involve inherent risks associated with operating on public roadways alongside oversize loads, and the allocation of liability between Joyner, the Client, and the load carrier reflects the distinct roles each party plays in the safe execution of an oversize move. This Disclaimer supplements and is incorporated into the Joyner Pilot / Escort Service Agreement.

2. Joyner's Role & Liability Scope

Joyner provides pilot car escort services as a safety support function for oversize load movements. Joyner's liability is limited to damages directly caused by Joyner's own negligence in the performance of pilot car escort services within the scope described in the Safety Compliance Policy. Joyner is not the motor carrier of record for the oversize load and is not responsible for the load carrier's operation, the load's compliance with permit conditions, or the safety of the oversize load itself.

3. Insurance Coverage

Joyner maintains commercial automobile liability insurance covering its pilot vehicles during escort operations, meeting or exceeding the minimum requirements of applicable state law. Joyner's insurance provides coverage for bodily injury and property damage arising from the negligent operation of Joyner's pilot vehicles. Clients and load carriers who believe they have a claim arising from Joyner's pilot car operations may contact claims@myjoyner.com to initiate the claims process.

4. Exclusions from Joyner's Liability

Joyner is not liable for loss, damage, injury, or death arising from the following:

  • Load carrier negligence: Accidents, damage, or injuries caused by the load carrier's operation of the oversize vehicle, including driver error, mechanical failure, improper load securement, or violation of permit conditions
  • Inaccurate load information: Accidents, permit violations, or clearance incidents resulting from Client's failure to provide accurate load dimensions, weight, or configuration information
  • Permit non-compliance by Client: Consequences arising from the load exceeding permit dimensions, traveling on prohibited routes, or operating outside permitted travel times — where such non-compliance was not caused by Joyner's error
  • Third-party conduct: Accidents or injuries caused by other motorists or third parties not under Joyner's control
  • Road and infrastructure conditions: Damage caused by road conditions, bridge or overhead clearance issues that were not identified in a Joyner route survey or that changed after the survey was conducted
  • Force Majeure Events: Service failures or incidents caused by Acts of God, severe weather, natural disasters, or other circumstances beyond Joyner's reasonable control — see the Joyner Force Majeure Policy
  • High pole clearance limitations: Damage to overhead utilities, structures, or the load itself resulting from overhead clearance conditions that could not reasonably have been identified through the high pole measurement process, including utility lines that were not present at the time of survey or that were lower than their marked or surveyed height

5. Client's Responsibility for Load Carrier

The load carrier — the motor carrier operating the oversize vehicle — is an independent entity from Joyner. The load carrier is solely responsible for the safe operation of the oversize vehicle, compliance with all applicable regulations and permit conditions, and the safety of the cargo. Client is responsible for ensuring that the load carrier engaged for any move escorted by Joyner is properly licensed, insured, and qualified to transport the oversize load.

JOYNER IS NOT LIABLE FOR ACCIDENTS, CARGO DAMAGE, PROPERTY DAMAGE, PERSONAL INJURY, OR DEATH CAUSED BY THE LOAD CARRIER'S OPERATION OF THE OVERSIZE VEHICLE, REGARDLESS OF WHETHER JOYNER'S PILOT CAR WAS PRESENT AND OPERATING AT THE TIME OF THE INCIDENT.

6. Limitation of Joyner's Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, JOYNER'S TOTAL LIABILITY TO CLIENT FOR ALL CLAIMS ARISING OUT OF OR RELATING TO PILOT CAR SERVICES PROVIDED UNDER A SINGLE SERVICE ORDER SHALL NOT EXCEED THE TOTAL AMOUNT PAID BY CLIENT TO JOYNER FOR THAT SERVICE ORDER. IN NO EVENT SHALL JOYNER BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM PILOT CAR SERVICES, INCLUDING LOST PROFITS, CARGO DAMAGE NOT CAUSED BY JOYNER'S NEGLIGENCE, PERMIT DELAY COSTS, OR PROJECT SCHEDULE IMPACTS.

7. Client Indemnification of Joyner

Client agrees to indemnify, defend, and hold harmless Joyner and its affiliates, officers, employees, pilot car operators, and agents from and against all claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising from:

  • The load carrier's operation of the oversize vehicle during Joyner-escorted moves
  • Client's failure to provide accurate load dimension, weight, or configuration information
  • The load exceeding permit conditions, whether as to dimensions, weight, route, or travel time
  • Damage to roads, bridges, utilities, or third-party property caused by the oversize load
  • Claims by third parties arising from the movement of the oversize load
  • Client's or load carrier's violation of applicable law or permit conditions

8. Third-Party Claims

Oversize load movements on public roadways may result in claims by third parties — including other motorists, property owners, utility companies, and state or local highway authorities — for property damage, roadway damage, or personal injury. Joyner is not liable for third-party claims arising from the movement of the oversize load itself, regardless of Joyner's pilot car presence. Client and the load carrier are responsible for resolving third-party claims arising from the oversize load movement and for maintaining appropriate insurance coverage for such claims.

9. Notice of Claim

To preserve a claim against Joyner arising from pilot car services, Client must provide written notice of the claim to Joyner within thirty (30) days of the incident giving rise to the claim. Submit written notice to claims@myjoyner.com with the service order number, date of the move, description of the incident, and description of the claimed damages. Failure to provide timely written notice may result in denial of the claim.

10. Dispute Resolution & Governing Law

All disputes arising out of or relating to this Disclaimer are subject to the Joyner Arbitration & Dispute Resolution Policy, including the binding arbitration agreement and class action waiver. This Disclaimer is governed by the laws of the State of Georgia and applicable federal transportation law.
