Joyner Mobility — Assisted Transportation Disclaimer

1. Purpose

This Assisted Transportation Disclaimer ("Disclaimer") describes the scope and limitations of physical assistance provided by Joyner Transportation & Logistic Services LLC ("Joyner," "we," "us," or "our") drivers and certified nursing assistants (CNAs) in connection with Joyner Mobility non-emergency medical transportation ("NEMT") and assisted transportation services. By booking or using Joyner Mobility services, you acknowledge and agree to the limitations described in this Disclaimer. This Disclaimer supplements and is incorporated into the Joyner Mobility Rider Policy.

2. Nature of Joyner Mobility Services

Joyner Mobility provides ground transportation services for individuals who require assistance due to age, disability, medical condition, or mobility impairment. Joyner Mobility is a transportation service — not a medical, clinical, or home health care service. Joyner drivers and CNAs are trained to provide safe, respectful transportation assistance within the scope described in this Disclaimer. They are not licensed healthcare providers and are not authorized to provide clinical care, medical treatment, or skilled nursing services.

3. Scope of Physical Assistance Provided

Joyner Mobility drivers and CNAs are trained and authorized to provide the following levels of physical assistance, based on the service level booked:

3.1 Ambulatory Assistance

  • Offering a steady arm or hand for balance and support while walking to and from the vehicle
  • Opening and closing vehicle doors
  • Assisting the rider in safely entering and exiting the vehicle
  • Carrying light personal belongings (bags, purses, small medical equipment cases)

3.2 Wheelchair Assistance

  • Pushing a manual wheelchair to and from the vehicle
  • Operating the vehicle's wheelchair lift or ramp
  • Securing the wheelchair and rider using vehicle tie-down and occupant restraint systems in accordance with applicable ADA and FMCSA securement standards
  • Releasing and restoring wheelchair securement at the destination

3.3 Door-Through-Door Assistance

  • Accompanying the rider from inside the origin location (e.g., apartment, room, facility) to the vehicle
  • Accompanying the rider from the vehicle to inside the destination location (e.g., medical waiting room, clinic entrance)
  • Operating standard building doors, elevators, and accessible entrances

3.4 CNA-Level Assistance (where CNA service is booked)

  • All ambulatory and wheelchair assistance described above
  • Providing companionship and verbal support during transport
  • Monitoring rider comfort and alertness during transport and reporting concerns to appropriate contacts
  • Assisting with repositioning within the vehicle for comfort (not clinical repositioning)

4. Limitations of Physical Assistance

Joyner Mobility drivers and CNAs are expressly prohibited from and not trained to provide the following:

  • Full transfers: Lifting a rider who is completely non-weight-bearing from a bed, chair, or floor to a wheelchair or vehicle seat. Riders who require full transfers must arrange for a personal care attendant (PCA) or caregiver to accompany them and perform transfers.
  • Clinical assessments: Taking vital signs, assessing medical symptoms, performing clinical evaluations, or making any determination about a rider's medical condition or fitness for transport
  • Medication administration: Administering, preparing, or assisting with any medication, including oral medications, injections, inhalers, or topical treatments
  • Medical procedures: Performing any medical or nursing procedure, including wound care, catheter care, tube feeding, suctioning, or oxygen titration
  • Emergency medical response: Providing emergency medical care beyond basic first aid. In a medical emergency, the driver will stop the vehicle in a safe location and call 911 immediately.
  • Behavior management: Physically restraining a rider or managing aggressive or combative behavior through physical means. If a rider's behavior poses a safety risk to the driver or other occupants, the driver may terminate the trip and contact appropriate emergency services.
  • Personal hygiene: Assisting with bathing, toileting, incontinence care, or personal hygiene tasks
  • Dietary assistance: Preparing food, assisting with feeding, or administering nutrition through any device

5. Rider and Booking Agent Responsibilities

To ensure safe and appropriate transportation, the person booking Joyner Mobility services — whether the rider, a family member, caregiver, or healthcare facility — is responsible for:

  • Accurately disclosing the rider's mobility level, physical assistance needs, and any medical equipment requirements at the time of booking
  • Arranging for a personal care attendant (PCA), caregiver, or licensed healthcare professional to accompany the rider if the rider requires assistance beyond the scope described in Section 3
  • Ensuring the rider is medically stable and appropriate for non-emergency ground transportation at the time of the scheduled trip
  • Notifying Joyner at least 24 hours in advance of any change in the rider's condition or assistance needs that may affect the trip
  • Ensuring that any portable medical equipment the rider is bringing (oxygen, CPAP, IV pump, etc.) is in safe working order and that the rider or accompanying caregiver is responsible for its operation

6. Medical Emergencies During Transport

Joyner Mobility vehicles are not equipped as ambulances and drivers and CNAs are not paramedics or EMTs. In the event of a medical emergency during transport:

  • The driver will immediately pull over in a safe location
  • The driver will call 911 and request emergency medical services
  • The driver will notify the rider's emergency contact if one has been provided
  • The driver will remain with the rider until emergency services arrive, providing comfort and basic first aid within their training (CPR/AED if trained and certified)
  • The driver will contact Joyner dispatch immediately

Joyner is not liable for outcomes resulting from medical emergencies that occur during transport that are not caused by Joyner's negligence. See the Medical Liability Disclaimer for further information.

7. Right to Decline or Terminate Service

Joyner reserves the right to decline to begin or to terminate a trip if:

  • The rider's assistance needs exceed the scope described in this Disclaimer and no appropriate caregiver is present
  • The rider appears to be in acute medical distress requiring emergency care
  • The rider's condition or behavior poses a safety risk to the driver, CNA, or other vehicle occupants
  • The booking information provided does not accurately reflect the rider's actual assistance needs

In such cases, Joyner will make reasonable efforts to ensure the rider's safety before departing, including contacting emergency services or the rider's emergency contact as appropriate.

8. Limitation of Liability

JOYNER'S LIABILITY IN CONNECTION WITH PHYSICAL ASSISTANCE PROVIDED DURING MOBILITY SERVICES IS LIMITED TO DIRECT DAMAGES CAUSED BY JOYNER'S NEGLIGENCE IN THE PERFORMANCE OF ASSISTANCE WITHIN THE SCOPE DESCRIBED IN THIS DISCLAIMER. JOYNER IS NOT LIABLE FOR: (A) INJURIES OR OUTCOMES RESULTING FROM ASSISTANCE REQUESTS THAT EXCEED THE SCOPE OF THIS DISCLAIMER; (B) MEDICAL CONDITIONS OR EVENTS THAT ARE NOT CAUSED BY JOYNER'S NEGLIGENCE; (C) OUTCOMES RESULTING FROM INACCURATE OR INCOMPLETE DISCLOSURE OF THE RIDER'S ASSISTANCE NEEDS AT THE TIME OF BOOKING; OR (D) THE ACTS OR OMISSIONS OF PERSONAL CARE ATTENDANTS OR CAREGIVERS ACCOMPANYING THE RIDER.

9. Governing Law & Dispute Resolution

This Disclaimer is governed by the laws of the State of Georgia. Disputes are subject to the Joyner Arbitration & Dispute Resolution Policy.
