Joyner Autow — Roadside Assistance Terms
1. Purpose & Scope
These Roadside Assistance Terms ("Terms") govern the specific roadside assistance services provided to enrolled Joyner Autow members ("Member," "you," or "your") by Joyner Transportation & Logistic Services LLC ("Joyner," "we," "us," or "our") and its authorized service providers. These Terms supplement and are incorporated into the Autow Membership Terms. In the event of a conflict between these Terms and the Membership Terms, the Membership Terms control.
2. Covered Roadside Assistance Services
Subject to your membership tier coverage limits, the following roadside assistance services are available to eligible Autow members:
2.1 Emergency Towing
Towing of a disabled covered vehicle to the nearest qualified repair facility, or to a repair facility of your choice within the towing mileage allowance for your membership tier. Towing is available 24 hours a day, 7 days a week, 365 days a year. Towing mileage beyond the allowance for your tier is available at the applicable per-mile overage rate, which will be charged to the payment method on file.
2.2 Battery Jump-Start
On-site jump-start service for a covered vehicle with a discharged battery. If the vehicle does not start after a jump-start attempt, towing to a repair facility will be arranged under the towing benefit. Battery replacement is not included in the jump-start service and is the member's responsibility.
2.3 Flat Tire Change
Mounting of your vehicle's spare tire in exchange for a flat or damaged tire, provided the spare is present, properly inflated, and in serviceable condition. If no serviceable spare is available, towing to a repair facility will be arranged. Tire repair or replacement costs are not covered.
2.4 Emergency Fuel Delivery
Delivery of up to three (3) gallons of the appropriate fuel type to a covered vehicle that has run out of fuel. The cost of the fuel delivered is the member's responsibility and will be charged to the payment method on file at the applicable current pump price plus a delivery service fee. Fuel delivery is available once per membership year per member.
2.5 Lockout Assistance
On-site lockout assistance for a member who is locked out of a covered vehicle. Service includes gaining entry to the vehicle through non-destructive means where possible. Joyner and its service providers are not responsible for damage to the vehicle resulting from lockout entry where non-destructive entry is not reasonably possible. Replacement of lost keys or key fobs is not covered.
2.6 Winching / Vehicle Extraction
Winching or extraction of a covered vehicle that is stuck in snow, mud, sand, or a ditch within 100 feet of a paved or improved road surface, where the extraction can be performed safely without specialized heavy equipment. Extractions requiring specialized equipment, off-road recovery, or extended winching are not covered under standard membership tiers.
3. Service Availability & Dispatch
Autow roadside assistance is available 24 hours a day, 7 days a week, 365 days a year throughout the continental United States, Alaska, Hawaii, and U.S. territories where service providers are available. Service availability in remote or rural areas may be limited by local provider availability, and response times in such areas may be extended.
Upon receiving a valid service request, Joyner will dispatch the nearest available qualified service provider. Estimated arrival times are good-faith estimates based on provider availability, distance, and current traffic and road conditions. Joyner does not guarantee specific arrival times and is not liable for delays caused by factors outside its control, including weather, traffic, road closures, or provider availability in remote areas.
4. Member Location Requirements
To receive roadside assistance, you or an authorized representative must be present at the vehicle's location when the service provider arrives, unless otherwise arranged with Joyner dispatch in advance. If no authorized person is present when the service provider arrives and Joyner is unable to reach you within fifteen (15) minutes, the service call may be cancelled and counted against your annual service call limit.
You must be able to provide the service provider with access to the vehicle. Joyner and its service providers are not responsible for additional charges or delays resulting from restricted access to the vehicle's location (e.g., gated communities, private parking structures, secured lots).
5. Third-Party Service Providers
Joyner delivers roadside assistance through a network of independent, pre-qualified third-party service providers ("Service Providers"). Service Providers are independent contractors and are not employees or agents of Joyner. Joyner uses commercially reasonable efforts to maintain a network of qualified, insured Service Providers but does not guarantee the performance, response time, or quality of any specific Service Provider. Joyner's liability for the acts or omissions of Service Providers is limited as described in Section 8.
6. Vehicle Damage During Service
Joyner and its Service Providers exercise reasonable care in providing roadside assistance services. However, certain types of service — particularly towing, winching, and lockout assistance — carry an inherent risk of incidental damage to the vehicle. The following terms apply to vehicle damage during service:
- Pre-existing damage: Service Providers will note any pre-existing damage on the service record prior to beginning work. Joyner is not responsible for pre-existing damage.
- Damage caused by service: If your vehicle sustains damage directly caused by a Service Provider's negligence during the performance of roadside assistance, you must report the damage in writing to Joyner within 48 hours of the service call by contacting autow@myjoyner.com. Late-reported damage claims may not be accepted.
- Liability cap: Joyner's maximum liability for vehicle damage caused during roadside assistance is limited to the actual cash value of the vehicle at the time of the damage, not to exceed the limit set forth in the Joyner Limitation of Liability Policy.
7. Personal Property
Joyner and its Service Providers are not responsible for personal property left in a vehicle during towing or other roadside assistance services. You are responsible for removing valuables and personal property from your vehicle prior to towing. Joyner recommends that members maintain renters' or homeowners' insurance coverage for personal property.
8. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, JOYNER'S TOTAL LIABILITY TO A MEMBER FOR ANY CLAIM ARISING OUT OF OR RELATED TO A SPECIFIC ROADSIDE ASSISTANCE SERVICE CALL SHALL NOT EXCEED THE LESSER OF: (A) THE ACTUAL CASH VALUE OF THE VEHICLE AT THE TIME OF THE INCIDENT; OR (B) FIVE HUNDRED U.S. DOLLARS ($500.00) PER INCIDENT. JOYNER IS NOT LIABLE FOR CONSEQUENTIAL, INCIDENTAL, SPECIAL, OR PUNITIVE DAMAGES, INCLUDING LOST TIME, TRANSPORTATION COSTS, HOTEL OR LODGING EXPENSES, OR OTHER INDIRECT LOSSES, UNLESS TRIP INTERRUPTION BENEFITS ARE INCLUDED IN YOUR MEMBERSHIP TIER AND THE CLAIM QUALIFIES UNDER THOSE BENEFIT TERMS.
9. Trip Interruption Benefits
Members enrolled in Autow Plus and Autow Premier tiers are eligible for trip interruption benefits when a covered breakdown occurs more than 100 miles from the member's primary residence and results in an overnight stay. Eligible reimbursements include reasonable hotel/lodging expenses and meal expenses up to the per-day limit for your membership tier, for a maximum of three (3) consecutive nights. Receipts are required for all reimbursement claims. Trip interruption claims must be submitted within thirty (30) days of the qualifying breakdown. Trip interruption benefits are not available for breakdowns within 100 miles of the member's primary residence.
10. Non-Covered Situations
Roadside assistance is not available under these Terms for:
- Vehicles that are not covered under the member's Autow membership tier
- Breakdowns caused by racing, off-road use, or use of the vehicle in a manner inconsistent with its design
- Vehicles that are impounded, confiscated, or involved in a law enforcement action
- Situations involving criminal activity
- Vehicles abandoned on public roads where towing is required by law enforcement (law enforcement-ordered tows are not covered)
- Service requests made within the 72-hour waiting period following initial enrollment
- Service calls that exceed the member's annual service call limit
- Towing mileage in excess of the member's tier allowance (overage charges apply)
11. Fraudulent or Abusive Use
Autow membership benefits are intended for genuine roadside emergencies. Fraudulent, abusive, or excessive use of membership benefits — including requesting service for ineligible vehicles, providing false information to obtain service, or using membership benefits in a manner inconsistent with their intended purpose — is a violation of the Membership Terms and may result in membership cancellation without refund and recovery of the cost of services fraudulently obtained.
13. Electric & Hybrid Vehicle Provisions
Electric vehicles (EVs) and hybrid vehicles require specialized roadside assistance procedures that differ from those applicable to standard internal combustion engine vehicles. The following provisions apply to members requesting roadside assistance for EVs and hybrids, consistent with motor club industry standards:
13.1 Battery Jump-Start
Standard jump-start procedures using jumper cables or a portable jump starter are not appropriate for the high-voltage traction battery of a fully electric vehicle. Joyner's standard jump-start service for EVs is limited to the 12-volt auxiliary battery (where present), which powers ancillary systems but does not propel the vehicle. If your EV has a depleted traction battery (the main drive battery), towing to a charging station or dealership is the appropriate service — not a jump-start.
For hybrid vehicles with a 12-volt auxiliary battery, standard jump-start service is available for the auxiliary battery only. Jump-starting a hybrid's high-voltage battery system is not within the scope of Autow roadside assistance.
13.2 Towing of EVs & Hybrids
Many EVs and some hybrids cannot be towed with the drive wheels on the ground (dolly towing) without risk of damage to the electric motor and regenerative braking system. Joyner will dispatch flatbed towing for EVs and for hybrids where the manufacturer's guidance indicates flatbed-only towing. Members should inform Joyner dispatch that their vehicle is an EV or hybrid when requesting towing service so that appropriate equipment can be dispatched.
Joyner is not liable for damage to an EV or hybrid vehicle's drivetrain, electric motor, or battery system resulting from towing performed in accordance with the member's instructions where the member failed to disclose the vehicle type, or where the member directed the use of non-flatbed towing against Joyner's recommendation.
13.3 Charge Assistance
Joyner does not currently provide mobile EV charging (on-site charge delivery) as a standard Autow membership benefit. Where mobile EV charging is available in a specific market through Joyner's service provider network, it will be noted in your membership benefit summary. In the absence of mobile charging, a depleted EV traction battery will be addressed through towing to the nearest available charging station or dealership within your towing mileage allowance.
13.4 Member Responsibility for EV Information
When requesting roadside assistance for an EV or hybrid, you must inform Joyner dispatch of the vehicle's make, model, and drivetrain type (fully electric, plug-in hybrid, or standard hybrid) so that appropriate equipment and procedures can be arranged. Failure to disclose EV or hybrid status may result in dispatch of equipment that is not appropriate for your vehicle, and Joyner is not responsible for resulting delays or damage.
14. Estimated Arrival Time Disclaimer
Estimated arrival times (ETAs) provided by Joyner dispatch at the time of service request are good-faith estimates based on the distance of the nearest available service provider, current traffic conditions, and road access at the time of dispatch. ETAs are not guaranteed delivery times and do not constitute a contractual commitment by Joyner or the service provider.
Actual arrival times may vary due to:
- Traffic conditions, accidents, or road closures between the provider's location and your breakdown location
- Changes in provider availability after dispatch
- Difficulty locating your exact breakdown location
- Weather conditions affecting travel speed or road access
- Geographic remoteness or limited road access at your breakdown location
If a service provider will be materially delayed beyond the initial ETA, Joyner dispatch will make reasonable efforts to notify you of the updated estimated arrival time. If the delay is significant and an alternative provider is available, Joyner may re-dispatch to a closer provider. Joyner is not liable for losses or expenses incurred as a result of service provider arrival times that exceed the initial ETA.
If you have not been contacted by the service provider and the ETA has passed by more than thirty (30) minutes without explanation, contact Joyner dispatch for a status update.
15. Service During Extreme Weather & Declared Emergencies
Joyner makes every effort to maintain roadside assistance service availability during severe weather and emergency conditions. However, the safety of service providers, members, and the public is the paramount concern, and service availability may be affected during extreme weather events and declared emergencies.
- Severe weather: During severe weather events — including hurricanes, tornadoes, ice storms, blizzards, flooding, and other extreme weather conditions — response times may be significantly extended due to road closures, limited service provider availability, and hazardous driving conditions. Joyner will dispatch assistance as soon as it is safe to do so.
- Declared emergencies: During federally, state, or locally declared emergencies — including natural disasters, public health emergencies, and civil emergencies — Joyner may be unable to provide service in affected areas due to road closures, evacuation orders, or government restrictions on vehicle movement. Service unavailability during a declared emergency constitutes a Force Majeure Event under the Joyner Force Majeure Policy and does not entitle members to a refund of membership fees.
- Member safety during extreme weather: If you are in immediate danger due to weather conditions at your breakdown location, call 911 immediately. Do not wait for roadside assistance if your safety is at risk.
- Service call limits during emergencies: Service calls requested during a declared emergency in an affected area will still count against your annual service call limit, provided service is successfully completed. Service calls that cannot be completed due to emergency conditions will not count against your limit.
16. Accessibility
Members with disabilities who require accessibility accommodations in connection with Autow roadside assistance services — including members who are deaf or hard of hearing, blind or visually impaired, or who have mobility impairments — should disclose their accommodation needs at the time of booking so that Joyner can dispatch an appropriate service provider and arrange any necessary accommodations. 17. Language Access
Joyner provides language access services through Language Line Solutions for members and service providers who require translation assistance. If you need assistance in a language other than English when calling Joyner dispatch, inform the representative of your preferred language and a Language Line interpreter will be connected to assist. If you and your service provider are unable to communicate directly due to a language barrier, call Joyner dispatch and Joyner will connect a Language Line interpreter to facilitate communication between you and the provider at no additional charge.
18. Minors in Vehicle
When a minor is present at a breakdown scene, the member must ensure the minor remains with a responsible adult at all times. Service providers will not transport minors under any circumstances. 19. Dispute Resolution & Governing Law
All disputes arising out of or relating to roadside assistance services are subject to the Joyner Arbitration & Dispute Resolution Policy. These Terms are governed by the laws of the State of Georgia, without regard to conflict-of-laws principles.
