Joyner Airport Shuttle — Liability Terms
1. Purpose
This Liability Terms document ("Terms") describes the scope and limitations of Joyner Transportation & Logistic Services LLC's ("Joyner," "we," "us," or "our") liability in connection with Airport Shuttle passenger transportation services. These Terms supplement and are incorporated into the Joyner Airport Shuttle Rider Terms. By using Joyner Airport Shuttle services, passengers and corporate clients acknowledge and agree to the liability framework described herein.
2. Insurance Coverage
Joyner maintains commercial automobile liability insurance for its Airport Shuttle operations meeting or exceeding the minimum requirements mandated by applicable state law for for-hire passenger transportation in each market where Joyner operates. Joyner's insurance provides coverage for bodily injury and property damage arising from the operation of Joyner's shuttle vehicles by Joyner's authorized drivers during the performance of transportation services.
Passengers who believe they have a claim arising from a Joyner Airport Shuttle trip may contact claims@myjoyner.com to initiate the claims process. Joyner will provide its insurance carrier's contact information upon request in connection with a valid claim.
3. Passenger Personal Injury Liability
Joyner's liability for personal injury to passengers arising from the operation of its shuttle vehicles is governed by applicable state tort law and is subject to the coverage limits of Joyner's commercial automobile liability insurance policy. Joyner's standard of care is that of a common carrier — Joyner must exercise the highest degree of care consistent with the practical operation of its vehicles for the safety of its passengers.
JOYNER'S TOTAL LIABILITY FOR PERSONAL INJURY TO ANY SINGLE PASSENGER ARISING FROM A SINGLE TRIP OR INCIDENT SHALL NOT EXCEED $1,500,000 PER PASSENGER OR THE APPLICABLE LIMIT OF JOYNER'S COMMERCIAL AUTOMOBILE LIABILITY INSURANCE POLICY FOR THE VEHICLE INVOLVED, WHICHEVER IS GREATER. THIS LIMITATION DOES NOT APPLY TO CLAIMS ARISING FROM JOYNER'S GROSS NEGLIGENCE OR WILLFUL MISCONDUCT.
4. Property Damage Liability
Joyner's liability for damage to passenger personal property — including baggage, electronics, clothing, and other items — is limited as described in the Airport Shuttle Baggage Liability Disclaimer. Specifically:
- Maximum liability per bag: $500.00
- Maximum liability per passenger per trip: $1,500.00
- Items excluded from coverage: cash, jewelry, electronics exceeding $500 in value, irreplaceable documents, and items listed in the Baggage Liability Disclaimer
5. Exclusions from Liability
Joyner is not liable for loss, injury, or damage arising from the following:
- Passenger conduct: Injuries or damage caused by the passenger's own negligence, intoxication, violation of Joyner's policies, or failure to wear a seatbelt
- Third-party conduct: Injuries or damage caused by the negligence or intentional acts of third parties not under Joyner's control, including other motorists
- Force Majeure: Delays, service interruptions, or injuries arising from Acts of God, severe weather, natural disasters, governmental actions, or other circumstances beyond Joyner's reasonable control — see the Joyner Force Majeure Policy
- Pre-existing conditions: Aggravation of a passenger's pre-existing medical condition during transport where Joyner has not been negligent
- Airport operations: Delays, losses, or injuries occurring within airport terminals, on airport property outside Joyner's designated pickup and drop-off zones, or in connection with airline operations
- Missed flights: Missed flights, connection losses, or related travel disruptions resulting from traffic, weather, or other factors outside Joyner's reasonable control, or resulting from a passenger's failure to allow adequate travel time
- Items left in vehicle: Personal property left in a Joyner shuttle vehicle after the passenger exits — see the Lost & Found provisions in the Shuttle Service Policy
6. Missed Flight Disclaimer
JOYNER IS NOT RESPONSIBLE FOR MISSED FLIGHTS, MISSED CONNECTIONS, OR ANY RESULTING COSTS — INCLUDING REBOOKING FEES, HOTEL EXPENSES, OR OTHER CONSEQUENTIAL LOSSES — ARISING FROM DELAYS IN SHUTTLE SERVICE, REGARDLESS OF CAUSE. PASSENGERS ARE SOLELY RESPONSIBLE FOR ALLOWING ADEQUATE TIME FOR TRAVEL TO THE AIRPORT, CHECK-IN, SECURITY SCREENING, AND BOARDING. JOYNER STRONGLY RECOMMENDS BOOKING SHUTTLE SERVICES WITH SUFFICIENT BUFFER TIME AS DESCRIBED IN THE SHUTTLE SERVICE POLICY.
7. Limitation on Consequential Damages
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, JOYNER IS NOT LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM AIRPORT SHUTTLE SERVICES, INCLUDING BUT NOT LIMITED TO: LOST BUSINESS OPPORTUNITIES; COSTS OF ALTERNATIVE TRANSPORTATION; HOTEL OR ACCOMMODATION EXPENSES DUE TO MISSED FLIGHTS; LOST PROFITS; OR EMOTIONAL DISTRESS NOT ACCOMPANIED BY PHYSICAL INJURY — EVEN IF JOYNER HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
8. Notice of Claim
To preserve a claim against Joyner arising from an Airport Shuttle trip, you must provide written notice of the claim to Joyner within the following timeframes:
- Personal injury claims: Written notice within thirty (30) days of the incident giving rise to the claim
- Property damage or baggage claims: Written notice within twenty-four (24) hours of the trip completion — see the Baggage Liability Disclaimer
- All other claims: Written notice within thirty (30) days of the event giving rise to the claim
Submit written notice of claim to claims@myjoyner.com with your booking reference number, date of trip, description of the incident, and description of the claimed injury or loss. Failure to provide timely written notice may result in denial of the claim.
9. Indemnification by Passenger
Passengers agree to indemnify, defend, and hold harmless Joyner and its affiliates, officers, employees, drivers, and agents from and against all claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising from: (a) the passenger's own negligence or willful misconduct during the trip; (b) the passenger's violation of Joyner's policies; (c) damage to the vehicle caused by the passenger; or (d) claims by third parties arising from the passenger's conduct during the trip.
10. Dispute Resolution & Governing Law
All disputes arising out of or relating to these Liability Terms are subject to the Joyner Arbitration & Dispute Resolution Policy, including the binding arbitration agreement and class action waiver. These Terms are governed by the laws of the State of Georgia, without regard to conflict-of-laws principles.
