Driver Terms & Conditions

Two-Track Notice: These Terms apply to both W-2 employee drivers and 1099 independent contractor drivers. Sections that apply exclusively to one classification are clearly labeled. Where no label appears, the provision applies to both.

1. Purpose & Scope

These Driver Terms & Conditions ("Terms") govern the relationship between Joyner Transportation & Logistic Services LLC, a Georgia limited liability company ("Joyner," "we," "us," or "our"), and individuals who drive on behalf of Joyner in either a W-2 employee capacity or as 1099 independent contractors ("Driver," "you," or "your"). These Terms supplement, and do not replace, any separate written employment agreement, independent contractor agreement, offer letter, or onboarding documentation you have received from Joyner. In the event of a conflict between these Terms and a separately executed written agreement, the separately executed written agreement controls.

By performing driving services for or through Joyner, you acknowledge that you have read, understood, and agree to be bound by these Terms, the Joyner Community Guidelines, the Acceptable Use Policy, and all applicable Joyner policies.

2. Eligibility Requirements

To be eligible to drive for or through Joyner, you must at all times:

  • Be at least 21 years of age (18 years of age for non-CDL intrastate operations where permitted by applicable law)
  • Hold a valid driver's license appropriate for the vehicle class you will operate — including a valid Commercial Driver's License (CDL) with applicable endorsements for vehicles requiring CDL operation
  • Maintain a valid DOT medical certification (medical examiner's certificate) for CDL-required operations, consistent with 49 C.F.R. Part 391
  • Maintain a driving record that meets Joyner's minimum MVR standards, as assessed at onboarding and through periodic MVR monitoring
  • Pass Joyner's pre-employment background check, drug and alcohol test, and road skills assessment
  • Maintain eligibility to work in the United States
  • Comply with all applicable federal, state, and local licensing, permitting, and registration requirements for the vehicle(s) you operate

3. Drug & Alcohol Policy

Joyner maintains a strict drug and alcohol-free workplace policy for all drivers, consistent with DOT regulations (49 C.F.R. Parts 382 and 40) for CDL drivers and with Joyner's general workplace policy for non-CDL drivers. All drivers are subject to:

  • Pre-employment drug testing
  • Random drug and alcohol testing throughout the engagement
  • Post-accident drug and alcohol testing following any reportable accident, consistent with 49 C.F.R. § 382.303
  • Reasonable suspicion testing when a trained supervisor observes signs of drug or alcohol use
  • Return-to-duty and follow-up testing following any violation, where applicable

CDL drivers are subject to the DOT Drug and Alcohol Clearinghouse requirements (49 C.F.R. Part 382, Subpart G). By accepting these Terms, CDL drivers consent to Joyner querying the Clearinghouse at the time of hire and annually thereafter, as required by regulation.

A confirmed positive test, refusal to test, or violation of this Policy will result in immediate removal from safety-sensitive driving duties and may result in termination of employment or the contractor engagement.

4. Hours of Service & Fatigue Management

All drivers operating commercial motor vehicles subject to FMCSA Hours of Service regulations (49 C.F.R. Part 395) must comply fully with applicable HOS requirements, including:

  • Property-carrying driver HOS rules (11-hour driving limit, 14-hour on-duty window, 30-minute break requirement, 60/70-hour limits)
  • Passenger-carrying driver HOS rules, where applicable
  • Electronic Logging Device (ELD) requirements (49 C.F.R. Part 395, Subpart B), where applicable
  • Proper use and maintenance of ELD records and supporting documents

Drivers must never operate a vehicle while fatigued, regardless of whether they have remaining HOS. If you are too tired to drive safely, you must notify dispatch immediately and take appropriate rest. Joyner will not pressure any driver to violate HOS regulations or to drive while fatigued.

5. Vehicle Inspection & Maintenance

All drivers are required to:

  • Perform and document a pre-trip inspection of their assigned vehicle before each shift or trip, consistent with 49 C.F.R. § 396.13 for CMV drivers
  • Perform and document a post-trip inspection at the conclusion of each shift or trip, consistent with 49 C.F.R. § 396.11 for CMV drivers, and report any defects or deficiencies
  • Not operate a vehicle with a known safety defect that renders the vehicle out-of-service under applicable FMCSA out-of-service criteria
  • Report all vehicle maintenance needs, damage, accidents, and mechanical failures to dispatch or fleet management promptly

6. Safety Requirements

All Joyner drivers must at all times:

  • Operate vehicles in a safe, lawful manner consistent with applicable traffic laws, posted speed limits, and road conditions
  • Wear a seatbelt while operating any Joyner vehicle
  • Not use a handheld mobile phone or engage in any other distracted driving activity while operating a vehicle
  • Not operate a vehicle under the influence of alcohol, illegal drugs, prescription medication that impairs driving ability, or any other impairing substance
  • Complete all required Joyner safety training through Joyner University prior to operating a vehicle and on a periodic basis as required
  • Report all accidents, incidents, near-misses, and traffic citations to dispatch within 24 hours of occurrence
  • Cooperate fully with post-accident drug and alcohol testing and accident investigation procedures

7. Professional Conduct

All drivers are required to:

  • Treat all customers, passengers, dispatchers, and members of the public with dignity and respect, consistent with the Joyner Community Guidelines
  • Wear Joyner-approved attire or comply with applicable uniform standards while on duty
  • Maintain a clean, professional appearance while performing driving services
  • Not use profane, abusive, or threatening language with any customer, passenger, or member of the public
  • Not engage in any form of discrimination or harassment toward any customer, passenger, or member of the public
  • Follow all lawful dispatch instructions in a timely and professional manner
  • Not use personal mobile devices for non-work purposes while actively performing driving services

8. Cargo & Passenger Handling

Drivers are responsible for:

  • Verifying freight count, condition, and documentation at pickup and noting any exceptions on the bill of lading or delivery receipt before signing
  • Securing cargo properly in accordance with FMCSA cargo securement rules (49 C.F.R. Part 392, Subpart I) and Joyner's cargo securement procedures
  • Not opening, tampering with, or removing freight from sealed shipments without authorization
  • Obtaining proof of delivery (POD) at every delivery, including recipient signature where required
  • For passenger services: ensuring all passengers are properly seated and seatbelted before moving the vehicle; assisting passengers with mobility needs in accordance with Joyner Mobility protocols; and maintaining a safe, clean, and comfortable vehicle environment

9. Accident & Incident Reporting

In the event of any accident, collision, injury, or significant incident:

  • Stop immediately at the scene (where safe to do so) and ensure the safety of all persons involved
  • Call 911 if there are injuries, fatalities, or significant property damage
  • Contact Joyner dispatch immediately following the incident
  • Do not admit fault, make statements to third parties about the cause of the accident, or agree to any settlement without Joyner's authorization
  • Cooperate fully with law enforcement, Joyner's insurance carrier, and Joyner's accident investigation process
  • Complete Joyner's accident report form within 24 hours
  • Submit to post-accident drug and alcohol testing as required by Joyner policy and applicable DOT regulation

10. Compensation — W-2 Employee Drivers

(This section applies to W-2 employee drivers only.)

Compensation terms for W-2 employee drivers — including hourly rates, per-mile rates, overtime policies, and benefits — are set forth in your offer letter or employment agreement and are subject to Joyner's Employee Handbook. Joyner complies with all applicable federal and state wage and hour laws, including the Fair Labor Standards Act (FLSA) and applicable state minimum wage and overtime laws. W-2 drivers are entitled to all benefits of employment status, including workers' compensation coverage, unemployment insurance, and applicable payroll tax withholding.

11. Compensation — 1099 Independent Contractor Drivers

(This section applies to 1099 independent contractor drivers only.)

Compensation terms for 1099 independent contractor drivers — including per-load rates, per-mile rates, and dispatch fee structures — are set forth in your Independent Contractor Agreement. As an independent contractor, you are responsible for: (a) paying all applicable self-employment taxes; (b) obtaining and maintaining your own commercial auto liability insurance in the minimum amounts required by FMCSA and your Independent Contractor Agreement; (c) maintaining your own vehicle(s) in roadworthy condition; and (d) complying with all applicable licensing and regulatory requirements for your operation. Joyner will issue IRS Form 1099-NEC for annual payments exceeding applicable reporting thresholds.

YOUR STATUS AS AN INDEPENDENT CONTRACTOR MEANS THAT YOU ARE NOT AN EMPLOYEE OF JOYNER. YOU ARE NOT ENTITLED TO EMPLOYEE BENEFITS, WORKERS' COMPENSATION COVERAGE THROUGH JOYNER'S POLICY, OR UNEMPLOYMENT INSURANCE AS A RESULT OF YOUR CONTRACTOR ENGAGEMENT. YOU HAVE THE RIGHT TO WORK FOR OTHER COMPANIES AND CLIENTS SIMULTANEOUSLY, SUBJECT TO ANY NON-COMPETE OR NON-SOLICITATION PROVISIONS IN YOUR INDEPENDENT CONTRACTOR AGREEMENT.

12. Confidentiality

In the course of performing driving services for Joyner, you may have access to confidential information, including customer names and contact information, shipment details, delivery routes, pricing information, and proprietary business information. You must not share, disclose, or misuse any such confidential information during or after your engagement with Joyner. This confidentiality obligation survives the termination of your employment or contractor engagement.

13. Use of Joyner Technology

You may be required to use Joyner's mobile app, dispatch platform, ELD system, or other technology tools in connection with your driving services. Your use of Joyner technology is subject to the Acceptable Use Policy. You must not share your platform credentials with any other person and must report any suspected unauthorized access immediately.

14. Termination

W-2 Employee Drivers: Employment may be terminated by either party at any time, with or without cause, subject to applicable law and any notice requirements in your employment agreement. Grounds for immediate termination for cause include, but are not limited to: a confirmed positive drug or alcohol test; falsification of logs, records, or reports; theft or cargo misappropriation; serious safety violation; or conduct that violates Joyner's non-discrimination or anti-harassment policies.

1099 Independent Contractor Drivers: The contractor engagement may be terminated by either party in accordance with the notice provisions of your Independent Contractor Agreement. Joyner reserves the right to immediately terminate a contractor engagement for material breach of the Agreement or these Terms, including any of the grounds listed above for W-2 drivers.

15. Dispute Resolution & Governing Law

Disputes arising out of or relating to these Terms are subject to the Joyner Arbitration & Dispute Resolution Policy. These Terms are governed by the laws of the State of Georgia and applicable federal law, without regard to conflict-of-laws principles.

16. Changes to These Terms

Joyner may update these Terms at any time. Material changes will be communicated via Joyner One or direct notice. Continued performance of driving services after changes take effect constitutes acceptance of the revised Terms.
